1.1. Welcome to HelloJobs (the “Website”), operated by Dinamo Software Solutions (Pty) Ltd (“Dinamo”, “we”, “us”, or “our”), a private company incorporated in the Republic of South Africa with registration number 2019/240806/07 1.2. These Terms and Conditions (“Terms”) govern your access to and use of the Website, including all services, features, and content offered by HelloJobs. By accessing or using the Website, you confirm that you have read, understood, and agreed to be bound by these Terms. 1.3. If you do not agree with these Terms, you must immediately cease using the Website.
• Candidate – an individual who registers on the Website to seek employment. • Recruiter or Employer or Company – a company, recruitment agency, or representative who registers to search for and contact Candidates. • User – collectively refers to Candidates, Recruiters, and visitors of the Website. • Services – any functionality offered by HelloJobs, including candidate profile creation, CV uploads, recruiter access, job postings, and data-matching.
3.1. By using the Website, you warrant that you: • Are at least 18 years old; • Have full legal capacity to enter into binding contracts; • Will provide accurate, truthful, and complete information.
4.1. For Candidates: • Candidates may upload CVs, personal details, and employment preferences. • Candidates acknowledge that by submitting such data, they consent to being contacted by Recruiters registered with HelloJobs, and by Dinamo Software Solutions where a successful match is identified. • HelloJobs does not guarantee employment, interview selection, or any minimum number of job opportunities. 4.2. For Recruiters/Employers/Company: • Recruiters must register valid company details and comply with applicable South African labour and privacy laws. • Recruiters may only use candidate information for lawful recruitment purposes and may not resell, distribute, or misuse candidate data. • Misuse of data may result in suspension, termination, and potential legal action.
5.1. Candidate registration is free. 5.2. Recruiters may be required to pay subscription or access fees, as outlined in service agreements or written agreements between both parties. 5.3. All fees are exclusive of VAT unless expressly stated. Payments are non-refundable except where required by law.
6.1. Use of personal data is governed by our Privacy Policy, which forms part of these Terms. 6.2. By using HelloJobs, you expressly consent to the collection, processing, and storage of your data in line with the Protection of Personal Information Act, 2013 (POPIA).
7.1. All intellectual property rights in the Website, including trademarks, software, content, and design, are owned by or licensed to Dinamo Software Solutions (Pty) Ltd. 7.2. Users may not copy, reproduce, distribute, or create derivative works without prior written consent.
9.1. The Website is provided “as is” and “as available” without warranties of any kind. 9.2. HelloJobs does not guarantee continuous availability, error-free operation, or immunity from security threats. 9.3. To the fullest extent permitted by law, HelloJobs excludes liability for any loss, damage, or claims arising from use of the Website, except where caused by gross negligence or wilful misconduct.
Users agree to indemnify and hold harmless HelloJobs (operated by Dinamo Software Solutions Pty Ltd), its directors, employees, and agents from any claims, damages, or expenses arising from their use of the Website, violation of these Terms, or infringement of third-party rights.
HelloJobs reserves the right to suspend or terminate any account at its sole discretion, without prior notice, where a User breaches these Terms or applicable law.
These Terms shall be governed by and construed in accordance with the laws of South Africa. Users consent to the exclusive jurisdiction of the courts of South Africa for any disputes.
13.1. Account Registration & Verification • Recruiters must provide accurate company details (including registration number, VAT number, and contact person). • HelloJobs (the “Website”), operated by Dinamo Software Solutions (Pty) Ltd reserves the right to verify employer information before granting access. • Access may be withheld or suspended if details cannot be verified or if the company is linked to fraudulent or unlawful activity. 13.2. Use of Candidate Data • Recruiters may only access candidate profiles for genuine recruitment purposes. • Candidate data may not be copied, resold, shared, or transferred outside of your organisation without prior written consent from HelloJobs. • Bulk extraction, scraping, or database replication is strictly prohibited. • All candidate contact must comply with POPIA. Unsolicited marketing or discriminatory practices are not permitted. 13.3. Job Postings Job adverts must: o Be genuine, lawful, and accurately describe the opportunity. o Not mislead candidates regarding role, salary, location, or conditions. o Comply with South African labour, equity, and anti-discrimination laws. The following are strictly prohibited: o Multi-level marketing (MLM) schemes. o Posts for pyramid schemes, gambling, or unlawful services. o Content that is defamatory, abusive, discriminatory, or offensive. • HelloJobs reserves the right to remove any advert that breaches these rules or damages our reputation. 13.4. Fees & Payments • Recruiter access, including candidate searches and job postings, may require a subscription or service fee. • All fees are payable in advance, unless otherwise agreed in writing. • Payments must be made via the Website or invoicing system • HelloJobs may charge interest on overdue accounts at the maximum rate permitted by law. 13.5. Recruiter Responsibilities Recruiters acknowledge and agree that: • They are solely responsible for ensuring that job adverts comply with all applicable laws (including the Employment Equity Act and Labour Relations Act). • They will handle candidate data responsibly and in line with POPIA. • They must not discriminate against candidates on the basis of race, gender, age, religion, disability, or any other protected characteristic. • They must respect candidate requests to withdraw or delete personal data. 13.6. Liability & Indemnity (Recruiters) Recruiters indemnify HelloJobs (operated by Dinamo Software Solutions Pty Ltd) against claims, damages, or losses arising from: • Misuse of candidate data; • Misleading or unlawful job adverts; • Failure to comply with employment or privacy laws; • Non-payment of fees. • HelloJobs accepts no responsibility for the accuracy of candidate information, background checks, or employment outcomes. Recruiters are solely responsible for verifying candidate suitability. 13.7. Termination of Recruiter Accounts HelloJobs may suspend or terminate a recruiter’s account if: • They breach these Terms; • They misuse candidate data; • They post fraudulent, misleading, or unlawful job adverts; • They fail to pay fees when due. • Termination does not exempt the recruiter from outstanding payment obligations.
These Terms shall be governed by and construed in accordance with the laws of South Africa. Users consent to the exclusive jurisdiction of the courts of South Africa for any disputes. Recruiter use of HelloJobs is subject to South African law, and disputes shall be resolved in the courts of South Africa.
